Terms & Conditions Northe Passport

1. GENERAL

1.1 These Terms and Conditions Northe Passport, together with the Northe General Terms and Conditions apply to each agreement entered into between a customer that’s registered as a Northe customer with a user account in the Northe Mobile App (“you”) and Charge4go AB, organisation number 559239-8266, Kungsgatan 9, 111 43 Stockholm, Sweden (“Northe”) for the purchase and use of a charging plan with discounted tariffs (“Northe Passport Plan”).

1.2 Capital terms used in these Terms and Conditions Northe Passport but not defined herein shall have the same meaning as in the Northe General Terms and Conditions. Unless the context requires otherwise, a capital term used in these Terms and Conditions Northe Passport includes the plural and vice versa.

1.3 In case of a conflict or contradiction between these Terms and Conditions Northe Passport and the Northe General Terms and Conditions, these Terms and Conditions Northe Passport shall take precedence.

1.4 Northe Passport Plans are offered either as a one-time purchase for a pre-determined period in time (“Prepaid Plan”), or as a recurring subscription that’s active for an indefinite period until terminated by you or Northe (“Subscription Plan”). Unless explicitly indicated that a specific provision only applies to a Subscription Plan or Prepaid Plan, these Terms and Conditions Northe Passport apply to all Northe Passport Plans.

2. RIGHT OF WITHDRAWAL

2.1 Please note that the provisions in this Section only apply if you have purchased a Northe Passport Plan as a consumer.

2.2You have the right to withdraw from your purchase of a Northe Passport Plan within fourteen days from the date of purchase.

2.3 If you have used your Northe Passport Plan by charging at a charging station where the Northe Passport Plan’s tariffs apply, you will be entitled to a refund minus the cost of the service you have received (as determined by the difference between what you have paid for charging sessions using your Northe Passport Plan and what you would have paid if the Northe Passport Plan had not been active). Your refund will be paid out within fourteen days to the same payment method used to purchase the Northe Passport Plan. Northe will never charge any administrative fees for processing your refund.

3. NORTHE PASSPORT PLAN

3.1 A Northe Passport Plan allows you to charge at selected charging operators in the Northe Charging Network using the Northe Passport Plan’s tariffs. The tariffs may vary depending on which Northe Passport Plan you purchase. You can find information about the applicable tariffs when selecting a Northe Passport Plan, as well as here.

3.2 Upon purchase, the Northe Passport Plan will be added to ‘My Account’. Please note that it is not possible to add a Northe Passport Plan to a Billing Account.

3.3 The applicable fee for a Northe Passport Plan is displayed when selected in the Mobile App. Upon confirming your order, Northe will immediately attempt to process the fee from your chosen payment method. Upon successful withdrawal of funds, Northe will send an order confirmation to your registered email address. The order confirmation will include details of the Northe Passport Plan, such as the fee, tariffs and these Terms and Conditions Northe Passport.

3.4 You may continue to use the Mobile app and Northe’s charging services after a Northe Passport Plan has expired or been terminated. Please note, however, that the tariffs of the Northe Passport Plan will no longer be applicable.Please find specific information about Prepaid and Subscription Plans belowPrepaid Plans

3.5 A Prepaid Plan is valid from the date that you receive the order confirmation until the specified end date.

3.6 The duration of a Prepaid Plan is indicated when you place the order for the Northe Passport Plan. It is also stated in the order confirmation and within the Mobile App. The Prepaid Plan will automatically expire at the end of the specified term.Subscription Plans

3.7 A Subscription Plan is valid from the date you receive the order confirmation. A Subscription Plan has an initial term of between one to three months, depending on the Northe Passport Plan chosen (“Initial Term”). After the Initial Term, the Subscription Plan will continue indefinitely and can be terminated by you at any time, with the termination taking effect on the Date of Reference (as defined below).The Date of Reference is determined by the initial purchase date of a Subscription Plan. For example, if the Subscription Plan is purchased on the 25th, the Date of Reference for subsequent months will be the 24th. If the Date of Reference does not exist in a specific month, it will be the last day of that month instead.

3.8 After the expiration of the initial period, Northe will charge a monthly fee to your selected payment method on the Date of Reference.

3.9 If you have purchased a Subscription Plan, you must ensure that the selected payment method has enough funds to cover the monthly fee. If Northe is unable to withdraw funds from your selected payment method, your Subscription Plan will be temporarily frozen until full payment is received. If, following a reminder, you still have not added a payment method with sufficient balance, Northe reserves the right to terminate your Subscription Plan.

4. YOUR OBLIGATIONS

4.1 A Northe Passport Plan is personal to you. It is expressly prohibited to give a third-party access to a Northe Passport Plan (e.g., by providing credentials to your Northe user account or letting someone else use your charging card/tag).

4.2 Unless to the extent explicitly stated otherwise in these Subscription Terms, you must always adhere to the Northe General Terms and Conditions.

4.3 You must notify Northe via email (support@northe.app) at least four weeks before changing your residing or registered address to an address abroad. Northe is entitled to terminate any purchased Northe Passport Plan with effect from the date that you re-locate to another country.

4.4 In the event that you are in breach of any of the obligations under 4.1 – 4.3 above, Northe reserves the right to immediately and without prior notice terminate your Northe Passport Plan. Northe also reserves the right to prevent you from purchasing a Northe Passport Plan if Northe has reason to believe that you will not adhere to the obligations set under these Terms and Conditions Northe Passport.

5. UPDATES TO THESE TERMS

5.1 Northe may lower the price and/or tariff of a Charging Plan at any time without prior notification. For information regarding other changes, please see below.

5.2 If you have purchased a Prepaid Plan, no updates or changes to these Terms and Conditions Northe Passport will apply during the time your Prepaid Plan is active. However, if you choose to purchase a new Prepaid Plan or extend an existing Prepaid Plan after these Terms and Conditions Northe Passport have been updated or amended, the new terms will apply.

5.3 If you have purchased a Subscription Plan, Northe is entitled to update these Terms and Conditions Northe Passport, except for changes to pricing and/or tariffs of a purchased Northe Passport Plan (In which case Section 5.3 applies). Updates will be communicated to you by email at least four weeks before such changes come into effect. You may object to such changes by sending an email to support@northe.app. If you object to the changes, Northe reserves the right to terminate your Subscription Plan with four weeks’ notice.

5.4 If Northe intends to make changes to the pricing and/or tariffs that affect a Subscription Plan to which you are subscribed, Northe will inform you of such changes by sending an email to your registered email address and/or by giving you a notification in the Northe Mobile App. Please note that no changes to prices or tariffs will apply before the expiration of your Initial Term. If you do not explicitly accept the changes, Northe reserves the right to terminate your Subscription Plan with four weeks' notice or at the expiration of your Initial Term, whichever occurs later.

6. GOVERNING LAW AND JURISDICTION

6.1 These Terms and Conditions Northe Passport shall be governed and interpreted according to Swedish law. If you are a consumer, applicable and compulsory consumer protection legislation of the country or region where you have your habitual place of residence shall prevail over Swedish law.

6.2 If you are a business, entity, and/or individual using the Northe Passport Plan for trade or business activities, the exclusive place of jurisdiction for any dispute arising from the use of, or relating to a Northe Passport Plan, or these Terms and Conditions Northe Passport, is Stockholm, Sweden. This limitation does not apply if you have purchased a Northe Passport Plan as a consumer in another jurisdiction.
